By accessing or using the Magic Maps mobile application and the magicmaps.ai website (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Magic Maps is an AI-powered mapping application that generates curated walking routes, surfaces trending and noteworthy places, and provides AI-assisted information about locations. The Service uses artificial intelligence, real-time web data, and Apple Maps to deliver its features.

3. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's consent to use the Service.

4. User Conduct

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights
  • Submit false, misleading, or malicious queries or content
  • Attempt to reverse-engineer, decompile, or disassemble the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Use the Service for any commercial purpose without our prior written consent
  • Scrape, harvest, or collect data from the Service by automated means

5. AI-Generated Content

The Service uses artificial intelligence to generate route suggestions, place descriptions, and conversational responses. AI-generated content is provided for informational purposes only and may not always be accurate, complete, or up to date. You should independently verify any information provided by the Service before relying on it. We are not responsible for decisions made based on AI-generated content.

6. Location Services

Certain features of the Service require access to your device's location. You may disable location services at any time through your device settings, but doing so may limit the functionality of the Service. You acknowledge that walking routes generated by the Service are suggestions and you are responsible for your own safety while navigating.

7. Intellectual Property

The Service, including its design, features, code, and content, is owned by Magic Maps and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

8. Third-Party Services

The Service integrates with third-party services including Apple Maps and AI providers. Your use of these third-party services is subject to their respective terms and conditions. We are not responsible for the availability, accuracy, or content of third-party services.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY INFORMATION PROVIDED THROUGH THE SERVICE (INCLUDING AI-GENERATED CONTENT) WILL BE ACCURATE OR RELIABLE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAGIC MAPS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify, defend, and hold harmless Magic Maps and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the Service or your violation of these Terms.

12. Termination

We may terminate or suspend your access to the Service at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of changes by posting the revised Terms on this page and updating the “Last updated” date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
